Our series of webinars on the terminology of civil law in English give you comprehensive and effective summary of the key terms of each field of civil law, including the law of persons, property, contracts, torts, family and inheritance. Each webinar focuses on the basic legal concept of the subject field in no more than fourty five minutes.
The law of persons deals with human beings as well as other entities defined to have a legal existence, with special regard to their rights. It is one of the traditional legs of the tripod of Roman law, together with property law and the law of obligations. As such, it does not exist in the common law system, and thus it does not have a specific terminology, unlike the law of intellectual property, a special element of this field, wherein terms used in common law have their civil law equivalents.
Property law, an ancient field of law, is one of the foundations of common law, dealing primarily with issues related to real property, which is of primary importance. The historical development of property law has resulted in concepts different from those of the civil law traditions. However, detailed analysis of the field reveals various similarities in the underlying concepts.
The law of contracts deals with one of the most typical and frequently used form of establishing obligations between peers. The webinar will look into the process of forming a contract. This is followed by a short analysis of the variuos problems with the contract that prevent reaching the desired legal effect. Then we learn about ways to secure the fulfilment of contractual obligations. Last, we learn the key terms related to ending a contract.
The law of tort deals with obligations created by wrongful actions that one party causes to the other. First we take a closer look at what is "wrong" in the civil law, then continue further elements of a tort, and analyze damage, causation and liability. This being a field where the terms are so inseparably connected to teir roots in the common law, we need to discuss some fundamental issues rooted in the differences of the legal systems.
Family law deals with the relationships between the various individuals constituting a family unit, as well as its establishment and dissolution. It also governs the rights and obligations of all parties including those of the children. As it is based on universally applicable concepts and practices, and being that it is statutory, the difference between legal systems does not play a significant role. Students will already be familiar with the terms used in this chapter.
The law of succession deals with the process of passing the property of a deceased person to the inheritors. The civil law regulations of the process are significantly different from those in probate law under common law jurisdictions. Using certain common law terms to describe the process under civil law is a real challenge addressed by this chapter.
