The term "standing" in Legal English



In legal English, "standing" refers to a party's right to bring a lawsuit or legal action.
A party must have standing to have their case heard by a court.

1. Standing for election: standing for an election means to be a candidate in an election. It involves running for a political office or position with the intention of being elected by the public. When someone stands for election, they have to announce their candidacy to declare their intention to run for office, then actively seek votes and support from the voters, they often participate in debates and other campaign events. They generally have to file necessary paperwork by submitting the required document to officially become a candidate.

2. Standing in civil action: standing in a civil action or "locus standi" in Latin is a condition that a party seeking a legal remedy must show they have, by demonstrating to the court, sufficient connection to and harm from the law or action challenged to support that party's participation in the case. Generally, they must have a direct and personal interest in the outcome of the case, they must have suffered or be likely to suffer harm as a result of the defendant's actions and must be able to show that the defendant's actions caused their harm.

3. Good standing of a corporation: It refers to its legal status as being in compliance with all applicable laws and regulations. A corporation in good standing is typically allowed to operate and conduct business without any restrictions or penalties. They have filed all required documents with the relevant government agency, such as articles of incorporation, annual reports, and tax returns, they have paid all required fees and taxes on time, they have followed proper corporate governance procedures, such as holding regular board meetings and maintaining accurate records, and last, but not the lease, they are not involved in any legal disputes or proceedings.
